Quiet December



Budget Bill

SB 2039 passed the Senate this week, and was quickly signed into law by Gov. Bruce Rauner. The Senate vote was 53-0 and was agreed upon in less than 10 minutes.

The $1.9 billion bill frees tax revenue on motor fuel and contains pass-through funds for local road districts, 911 services, lottery prizes, gaming revenues to local governments, various veteran and human services grants, and includes $28 million in GRF for domestic violence services and the Secretary of State's office.


Unemployment Insurance

Gov. Rauner approved HB 1285 on Fri., Dec. 4, which is Chamber-supported bill on unemployment insurance. The vote was 110-1. The bill broadens the definition of "misconduct" so that employers will not have to prove that eight kinds of misconduct that led to termination was "willful and deliberate". The bill also prevents the increase of $470 million in unemployment insurance taxes, and prevent further changes to the UI law until Jan. 1, 2018. Financial Transaction Tax Act

SB 2199 is a new piece of legislation that was filed last Friday by Sen. Michael Noland. The bill would impose a new financial transaction tax effective Jan. 1, 2016. The legislation would impose a tax on engaging in financial transactions on the Chicago Stock Exchange, the Chicago Mercantile Exchange, the Chicago Board of Trade, and the Chicago Board of Options Exchange at a rate of $1 per transaction for which the underlying asset is an agricultural product and $2 per contract for all other transactions. The taxes collected would be earmarked for school funding. 

This Illinois Chamber of Commerce would strongly oppose this legislation if forward movement occurs.

The House and Senate are scheduled to return to Springfield on January 13.

Legislative Victories




Last week, following a concerted effort by the Chamber, our members, and our allies, Congress approved a five-year highway and mass transit bill that will increase infrastructure funding, reauthorize the Ex-Im Bank, implement an important permit streamlining provision, and make some helpful financial services reforms.

The president signed that bill into law on Friday, marking a major victory for the business community and the American economy. 
  • Funding. The bill provides $305 billion over five years for highways and mass transit, giving states the certainty they need to undertake long-term projects and to begin to address the backlog of much-needed transportation and transit work.
  • Ex-Im Bank. Even though the Ex-Im Bank enjoys overwhelming bipartisan support in both houses of Congress, its revival was far from a sure thing following the expiration of its charter in June. This reauthorization could not come soon enough as American jobs were already being lost or moved overseas due to lack of access to Ex-Im financing.
  • Permit Streamlining. The permit streamlining provisions in the highway bill are groundbreaking and highly significant. They will improve and speed up the review and approval of permitting for complex development projects, ensuring that projects are not unnecessarily delayed or canceled because of ineffective and uncoordinated reviews by federal agencies.
  • Financial Services Reform. The highway bill also contains a number of provisions that will provide some targeted regulatory relief for smaller financial institutions and help small and growing businesses obtain capital. Specifically, the measures will reduce corporate reporting costs for smaller companies; help emerging growth companies access financing; and amend Dodd-Frank in a number of ways to reduce regulatory burdens. 
Thank you for all that you did to make these accomplishments possible. The efforts of you and your members demonstrate how the business community can truly make a difference in the passage of common sense policies that drive growth and job creation.

IL Chamber: Government Affairs Report



Budget Negotiation Meeting

Gov. Bruce Rauner has called a meeting with legislative leaders on Wed., Nov. 18. An interesting twist is that this meeting will be public. So the media can attend. While there is speculation that little will come of a meeting that includes TV cameras, it is nonetheless a meeting.


Unemployment Insurance Talks

Negotiations on unemployment insurance reform continue at the Capitol. The Chamber will bring you details as soon as there is movement to report.

Government Consolidation Panel

Illinois Chamber President and CEO Todd Maisch participated in a panel that included Sen. Linda Holmes and Lake County Chairman Aaron Lawler to discuss local government efficiency and consolidation efforts. This panel was part of the first-ever Transform Illinois conference held in Chicago. The conference focused on current efforts to increase government efficiencies, and what needs to happen in the future.


Procurement Summit in Springfield

We still have room for few more people at the Chamber's procurement summit on Tues., Nov. 17 for anyone interested in state government's buying process. Seasoned veterans of state procurement as well as businesses interested in how to access state procurement opportunities will appreciate hearing from the speakers:

Staff Changes

The Chamber is pleased to announce that Katie Stonewater is joining us as the executive director of the Energy Council. Stonewater most recently worked in the private industry for a female-owned small business that supports multi-million dollar government contracts. 

Before that, she focused on energy and telecommunications issues for Gov. Pat Quinn, helping to run the Biofuels Investment Working Group, and she handled energy policy legislation for Cong. Jerry Costello in Washington D.C. Her knowledge and experience on energy issues will be invaluable. Please help us welcome her aboard!

Legislative Announcement


NLRB rules against business in pivotal joint-employer decision


The Obama administration is redefining what it means to be an employer.
The National Labor Relations Board (NLRB) on Thursday handed down one of its biggest decisions of President Obama’s tenure, ruling that companies can be held responsible for labor violations committed by their contractors.
While the ruling from the independent agency specifically deals with the waste management firm Browning-Ferris, the so-called “joint employer” decision could have broad repercussions for the business world, particularly for franchise companies.
Opponents of the action warn the ruling could hurt businesses as diverse as restaurants, retailers, manufacturers and construction firms, as well as hotels, cleaning services and staffing agencies.
“This decision has broad implications, as it appears to upend decades of settled law defining who the employer is under the National Labor Relations Act,” said Randy Johnson, a senior vice president at the U.S. Chamber of Commerce.
Restaurants could see the biggest changes. Fast food chains such as McDonald’s and Burger King will likely assert more authority over — or even cut ties altogether with — local franchise owners, business advocates say.
At issue in the case was whether Browning-Ferris was responsible for the treatment of contracted employees. The Houston-based company hired Leadpoint Business Services to staff a recycling facility in California. 
The labor board determined Browning-Ferris should be considered a "joint employer" with the Phoenix-based staffing agency. As a result, the company can be pulled into collective bargaining negotiations with those employees and held liable for any labor violations committed against them.
The NLRB ruling is a sharp departure from previous decisions that stated companies were only responsible for employees who were under their direct control. Without the power to set hours, wages or job responsibilities, the earlier rulings held, companies could not be held responsible for the labor practices of the contractors.
But the National Labor Relations Board charted a new course Thursday, saying the old standard is “increasingly out of step with changing economic circumstances.”
Labor unions cheered the decision, saying it will help vulnerable workers challenge unresponsive employers.
"Simply put, labor laws in America have failed to keep pace as the workplace has continued to evolve," AFL-CIO President Richard Trumka said in a statement.
The NLFB ruling could affect the growing number of temporary workers and independent contractors who do not receive the same protections as full-time employees.
Rather than hiring their own employees, many companies have grown accustomed to turning to staffing agencies to supply temporary workers or contract with other companies to complete tasks.
The arrangement provides them with less responsibility than for in-house employees, but it can also place those employees in somewhat of a no man’s land. They don’t know who their boss is, because the person who tells them what to do does not pay them.
The NLRB is seeking to end that situation by holding that both companies responsible as joint employers, because they “share or co-determine those matters governing the essential terms and conditions of employment."
Teamsters union General President Jim Hoffa called the ruling a “victory for workers across America."
"Employers will no longer be able to shift responsibility for their workers and hide behind loopholes to prevent workers from organizing or engaging in collective bargaining,” Hoffa said.
The decision is the latest in a string of major victories for labor groups under the Obama administration, which has already issued several sweeping executive actions on worker protections and wages.
The NLRB, which now has a Democratic majority, has also taken steps to make it easier for employees to unionize.
The two Republican appointees on the labor board, Harry Johnson and Philip Miscimarra, dissented from Thursday’s 3-2 ruling.
They argued that “no bargaining table is big enough” for two companies.
"Changing the test for identifying the ‘employer,’ therefore, has dramatic implications for labor relations policy and its effect on the economy,” they wrote.
Business groups had been on the warpath in anticipation of the Browning-Ferris decision.  
The National Federation of Independent Business (NFIB), for instance, warned it could “blow up” longstanding business models.
The National Retail Federation (NRF) denounced the ruling as an instance of “unelected government bureaucrats creating roadblocks in the path of job creation.”
“This is further evidence that the NLRB has given up its position as an objective arbiter of workplace issues and sees itself as an advocate for organized labor as a means of imposing new workplace obligations and legal liabilities on well-known corporations,” said David French, the NRF’s senior vice president for government relations.
Companies are already threatening to cut ties with staffing agencies that help recruit temporary workers and subcontractors that provide janitorial and security services because they don’t want to be responsible for another company’s employees.
They say they would rather bring those jobs in-house to establish more control over the situation.
“It will make it much harder for self-employed subcontractors to get jobs,” said Beth Milito, senior legal counsel at the NFIB. “Subcontractors will come under pressure by their clients to change their employment policies or they’ll be cut out of the picture altogether."

Our AT&T U-verse High Speed Internet service brings customers a wide choice of Internet speeds, depending on their needs. With U-verse with AT&T GigaPowerSM, customers in select markets can download an HD movie in 36 seconds, a TV episode in three seconds and 25 songs in one second. We're planning to grow our 1 gigabit per second service, targeting up to 100 cities across the country.
